Court recommends murder charges against three officers over 2022 Masimba killings

A Kajiado court has recommended murder charges against three police officers over the killing of four Masimba residents during a 2022 protest, concluding that the officers' account of the deadly incident was unreliable and contradicted by forensic evidence.
Delivering the findings on November 12, 2025, the court ruled that ballistic analyses and autopsy reports clearly established that the victims died from gunshot injuries sustained during the chaotic protest.

The forensic findings, the court noted, directly undermined the version presented by the officers who took part in the operation, whose testimonies were marked by inconsistencies and appeared crafted to deflect blame.
According to the inquest's conclusions, Police Constables Hosea, Adam, and Wambua should face murder charges, with the court stating there was sufficient evidence linking them to the fatal shootings.
The court further recommended that several General Service Unit (GSU) officers involved in the operation be prosecuted for a range of offences, including unlawful use of a firearm, conspiracy to obstruct justice, conspiracy to commit murder, conspiracy to commit a felony, and acting as accessories after the fact.
The magistrate observed that the officers' conduct during and after the protest suggested a coordinated effort to conceal the truth and frustrate investigations.
"The evidence before this court points to a deliberate attempt to shield those responsible for the deaths," the magistrate stated in the ruling.
The inquest followed sustained public uproar after the killing of four locals during a demonstration at Masimba in Kajiado County - an incident that revived national debate on police accountability and the use of force during civilian protests.
With the recommendations now issued, the court has directed that the investigation file be forwarded to the Office of the Director of Public Prosecutions for further action.
